Terms of Service

1. Introduction and Business Identity

These Terms of Service ("Terms") govern your use of the ChessFeed.live platform. The platform is owned and operated by ZAYNHQ PORTAL, a company licensed in Dubai, United Arab Emirates (License Number: 1605147). By accessing our services, you agree to be bound by these Terms and the laws of the UAE.

2. Nature of Service (Intermediary Role)

ZAYNHQ PORTALacts solely as a technical intermediary connecting Users (Chess Learners) with Freelance Creators ("Streamers" or "Instructors") for educational and entertainment sessions.

  • We do not employ the streamers. Streamers are independent freelance creators.
  • We do not provide the chess instruction or advice directly.
  • The contract for the educational service is formed directly between the User and the Streamer.
  • We are not responsible for the quality, accuracy, or outcome of the advice provided by Streamers.
  • The platform is entirely free to use for standard queue access. Users only pay an optional fee to skip the queue and receive priority placement.

3. Interactive Tools & Virtual Environment

ChessFeed.live provides a proprietary virtual interface (the "Interactive Board") solely to facilitate the visual demonstration and interaction between the User and the Streamer.

This Interactive Board is a communication tool similar to a whiteboard or screen-sharing feature. It is provided "as-is" to assist in the mentorship session. The provision of this tool does not constitute a "gaming service" but rather a technical medium for the educational/entertainment session to take place.

4. Strict "No Gambling" Policy

This service is for educational and entertainment purposes only. Users are paying specifically for the Creator's time and expertise. Any form of wagering, betting, or "money matches" (paying to win a prize) is strictly prohibited on this platform. Violation of this rule will result in immediate permanent suspension.

5. Code of Conduct

We maintain a zero-tolerance policy for toxicity. During live sessions and interactions, you agree NOT to:

  • Engage in harassment, hate speech, or discriminatory behavior.
  • Use chess engines or external assistance during sessions (unless explicitly allowed for analysis).
  • Impersonate other users or entities.
  • Spam, advertise, or promote external services without authorization.

6. No-Shows and Cancellations

When joining a Streamer's queue (whether free or paid), you are expected to be present and ready when your turn arrives.

  • If you fail to be present when your session is called ("No-Show"), the Streamer has full and sole discretion on how to proceed.
  • Streamers reserve the right to skip you, cancel your turn entirely, or optionally re-add you to the queue at a later time.
  • No-shows are considered a fulfillment of the Streamer's obligation to offer the slot, and are completely ineligible for refunds.

7. Payments, Fees, and Commission

All payments are processed securely via Stripe. We do not store your credit card details.

  • The platform is free to use for all users joining the standard queue.
  • The only fee a user may pay is to skip the queue via the optional priority tiers (Skip, Skip+, VIP). This fee is for queue placement only and does not guarantee any particular outcome or quality of session.
  • ZAYNHQ PORTAL retains a flat 20% commission on all priority queue transactions processed through the platform. The remaining 80% is paid out to the Streamer.
  • Commission rates may be negotiated on a case-by-case basis depending on volume, partnership agreements, or promotional arrangements, at ZAYNHQ PORTAL's sole discretion.
  • Refunds are governed strictly by our Refund & Cancellation Policy. Please review it carefully before making a purchase.

8. Streamer (Creator) Terms

The following terms apply specifically to users who register as Streamers/Instructors on the platform:

8.1. Independent Contractor Status

Streamers are independent freelance creators and are not employees, agents, or representatives of ZAYNHQ PORTAL. Streamers are solely responsible for their own tax obligations, insurance, and compliance with applicable local laws in their jurisdiction.

8.2. Content and Conduct Responsibility

Streamers are solely responsible for all content they produce during sessions, including but not limited to:

  • The quality and accuracy of chess instruction provided.
  • Compliance with the platform's Code of Conduct and No Gambling policy.
  • Ensuring their stream content does not violate any third-party copyrights, trademarks, or intellectual property rights.
  • Maintaining a professional and respectful environment for all participants.

8.3. Post-Game Feedback (Optional)

Providing post-game feedback to players is entirely optional. Streamers may choose to rate a player or skip providing feedback. If skipped, the game itself serves as the learning experience for the player.

8.4. Queue and Session Management

  • Streamers have full discretion over their queue, including the right to skip, cancel, or re-order participants.
  • Streamers must make a good-faith effort to accommodate all paying users in their queue during the session. Repeated failure to serve paid queue entries may result in account review or suspension.
  • Streamers set their own pricing for priority queue tiers within the limits set by the platform.

8.5. Payouts and Commission

  • Streamers receive 80% of all priority queue revenue generated from their sessions. The platform retains the remaining 20% as a service commission.
  • Payouts are processed through Stripe Connect and are subject to Stripe's payout schedule and policies.
  • ZAYNHQ PORTAL reserves the right to withhold payouts in cases of suspected fraud, Terms violations, or pending dispute resolution.
  • Negotiated commission rates, if applicable, will be documented in a separate written agreement between the Streamer and ZAYNHQ PORTAL.

8.6. Account Suspension and Termination

ZAYNHQ PORTAL reserves the right to suspend or permanently terminate a Streamer's account for any of the following reasons:

  • Violation of the Code of Conduct or No Gambling policy.
  • Repeated failure to serve paid queue participants.
  • Fraudulent activity, including artificial inflation of queue entries or manipulation of ratings.
  • Any activity that brings the platform into disrepute or jeopardizes its standing with payment processors.

8.7. Intellectual Property

Streamers retain full ownership of their original content. By using the platform, Streamers grant ZAYNHQ PORTAL a non-exclusive, royalty-free license to display their public profile, session statistics, and username on the platform and for promotional purposes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UAE LAW, ZAYNHQ PORTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM THE USE OF THE PLATFORM OR ANY INTERACTION BETWEEN USERS AND STREAMERS.

10. Indemnification

You agree to indemnify, defend, and hold harmless ZAYNHQ PORTAL, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the platform, your violation of these Terms, or your violation of any rights of a third party.

11. Open Source & Third-Party Services

Stockfish Engine: Analysis on this platform may be powered by Stockfish, an open-source chess engine licensed under the GNU GPLv3. Reference source code and license details are available at their official repository.

Chess Platforms: We use public APIs from Chess.com and Lichess.org to verify player statistics and profiles. ChessFeed.live is an independent platform and is not affiliated with, endorsed by, or sponsored by Chess.com or Lichess.org.

12. Changes to Terms

ZAYNHQ PORTAL reserves the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the platform after such changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Dubai, United Arab Emirates. Any disputes arising from these Terms shall be resolved in the courts of Dubai.
